SMS Terms

These SMS Terms govern the text-message alert program offered by TixPulse, Inc., doing business as Tixxi ("Tixxi," "we," "us," or "our"). By opting in to receive text messages from Tixxi, you agree to these SMS Terms, our Terms of Service, and our Privacy Policy, which are incorporated here by reference.

1. The program

When you opt in, Tixxi sends recurring automated text messages related to the price alerts and account activity you choose — for example, notifications when a ticket price meets a threshold you set, and account or transactional messages. Message frequency varies based on the alerts you configure.

2. Consent is not a condition of purchase

Your agreement to receive text messages is not required to purchase any goods or services from Tixxi. You may use the Service without enabling SMS alerts.

3. Message & data rates

Message and data rates may apply, depending on your mobile plan. You are solely responsible for any charges from your wireless carrier. Not all mobile devices or carriers may be supported, and messages may not be deliverable in all areas.

4. Opting out

You can cancel SMS messages at any time by replying STOP to any message. After you send STOP, we may send one confirmation message acknowledging your opt-out. You may also manage SMS in your account settings. To opt back in, reply START or re-enable SMS in settings.

6. Your responsibilities

You represent that you are the account holder or authorized user of the mobile number you provide, and that you will notify us if you change or deactivate that number. You agree not to enroll any phone number that is not your own without authorization.

7. Wireless carrier authorization

By enrolling in the SMS program, you authorize your wireless carrier to disclose to Tixxi and its messaging service providers limited information about your account and device — such as your mobile number, carrier name, and device or subscriber status — solely to help us deliver messages reliably, verify your identity, and detect and prevent fraud. We use this information only for those purposes and do not use it for marketing. This authorization remains in effect while you participate in the SMS program and may be withdrawn by opting out as described in Section 4.

8. Carrier liability

Wireless carriers are not liable for delayed or undelivered messages. Tixxi, its messaging service providers, and the supported mobile carriers are not liable for any delays or failures in message receipt, as delivery is subject to effective transmission by your carrier and other factors outside our control.

9. Changes

We may modify these SMS Terms from time to time. We will post the updated version with a new "Last updated" date. Your continued participation in the SMS program after changes take effect constitutes acceptance.

10. Dispute resolution

The dispute-resolution and arbitration provisions in our Terms of Service apply to disputes arising from the SMS program.
